E-Sign Authorization and Agreement to Receive Electronic Disclosures and Notices


I authorize First Community Bank to use my electronic signature for all documents and agreements relating to this deposit account until I close all my accounts with First Community Bank or until I provide written notice of my withdrawal of consent.  Withdrawal of consent shall be in writing and mailed to First Community Bank, Attention: Customer Service Department, 1325 Harrison Street, Batesville, AR 72501.  This consent is to permit an electronic signature in lieu of a hand-written signature on any account documents.  I agree that my electronic signature will be enforceable to the full extent of an original hand-written signature.  I agree that my electronic signature on account documents will be enforceable in federal court, state court, arbitration and any other legal or regulatory setting.  I agree that I will not raise any defenses or claims attempting to invalidate the enforceability of the account documents bearing my electronic signature.


I agree to receive account opening disclosures and notices relating to this deposit account application electronically. I may revoke this Agreement at any time by either sending notice electronically in an E-mail to First Community Bank at customerservice@firstcommunity.net or in writing mailed to First Community Bank, Attention: Customer Service Department, 1325 Harrison Street, Batesville, AR 72501 at which time, after processing, I will eligible be to receive such notices and disclosures in paper form at no charge.


I understand that for accounts with multiple owners, only one account owner needs to authorize the service. In accordance with the terms of the First Community Bank deposit account agreement, all account owners will be bound by the decision of the account holder who authorizes this service. 


I understand and agree that even though I have agreed to receive disclosures and notices electronically, I may contact the Bank by telephone or E-mail to request that the Bank send a paper copy of a disclosure and notice that has already been sent or is available electronically, and that the Bank may charge a fee for that service. I agree that such fee can be deducted from any account that I own at the Bank. I agree to maintain a valid, active e-mail address. I must promptly notify the Bank of any change in my E-mail or postal address by contacting the Customer Service Department at 870-612-3400 or by E-mail at customerservice@firstcommunity.net. 


Funds Transfer Service Using Mobile Banking For Accounts Subject To The
Electronic Funds Transfer Act


Some of the transactions originated in Mobile Banking may be governed by the Electronic Funds Transfer Act and/or Regulation E. This governs accounts established by natural persons whose primary purpose is for personal, family, or household use. I understand I will receive these disclosures at account opening, located in the Account Terms and Conditions, in the Electronic Fund Transfers Your Rights and Responsibilities section. It covers all requirements regarding electronic transfers and transfer limitations.


I understand that my access in Mobile Banking allows me to be able to transfer funds, make payments, get account information, and makes deposits.


I agree I may be charged access fees by my cell phone provider based on my individual plan. Web access is needed to use this service. I understand I will need to check with my cell phone provider for details on specific fees and charges. 


Hardware and Software Requirements:
I understand that, in order to receive such disclosures electronically, I must have:


• an Internet web browser which is capable of supporting HTML and 128-bit SSL encryption;


• connection to the Internet;


• a current version of a program that accurately reads and displays Portable Document Format or “PDF” files, such as Adobe® Acrobat Reader® version 8.0 or above (available for downloading at https://get.adobe.com/reader/; and


• a computer or other device which is capable of supporting all of the above.  
I will provide and maintain electronic storage space to retain Notices in electronic form and understand that I will need a printer if I wish to retain Notices in paper form.


I understand that in the event I experience difficulties or have questions regarding notices or disclosures I can contact the Customer Service Department by telephone or E-mail. 


I understand, that if in the future, the Bank upgrades its Internet delivery system, with the result that I may need upgraded hardware and/or software that differs from the hardware and software requirements previously described, I may revoke this Agreement, without the imposition of fees, by either sending notice electronically in an E-mail to First Community Bank at customerservice@firstcommunity.net or in writing mailed to First Community Bank, Attention: Customer Service Department,
1325 Harrison Street, Batesville, AR 72501 at which time, after processing, I will eligible be to receive such notices and disclosures in paper form at no charge.
 


I understand and agree that the Bank retains the right, to the extent permitted by law, to amend this agreement in the future by providing me with written notice of such changes sent to my last known mailing address or by providing electronic notice of such changes sent to my last known E-mail address. In the future, should the Bank, by law or regulation, be permitted to deliver additional notices or disclosures to which I am entitled, I hereby agree to receive such notices or disclosures in electronic format sent to my last known E-mail address. 


Use of this service is subject to all applicable federal, state and local laws and regulations, and unauthorized use of the service is strictly forbidden.

INTEREST CHECKING

VARIABLE RATE INFORMATION

The interest rate and annual percentage yield on your account may change.

The current interest rate and annual percentage yield are displayed on the confirmation page of this application. NOTE: Annual Percentage Yield is abbreviated as "APY".

DETERMINATION OF INTEREST RATE

At our discretion, we may change the interest rate and annual percentage yield on your account.

FREQUENCY OF INTEREST RATE CHANGES

We may change the interest rate and annual percentage yield on your account at any time.

COMPOUNDING AND CREDITING

Interest will be compounded and credited to your account monthly.

If you close your account before the interest is credited, you will not receive the accrued interest.

MINIMUM BALANCE REQUIREMENTS

You must deposit a minimum of $50.00 to open this account. 

BALANCE COMPUTATION METHOD

We use the daily balance method to calculate the interest on your account. This method applies a daily periodic rate to the principal in the account each day.

ACCRUAL ON NON-CASH DEPOSITS

Interest begins to accrue on the business day you deposit non-cash items, for example, checks.

FEES AND CHARGES

A minimum balance fee of $8.00 will be imposed every statement cycle if the balance in the account falls below $750.00 on any day of the statement cycle.

Fees may be charged for overdrawing an account. These fees may apply to overdrafts created by check, in-person withdrawal, ATM withdrawal or other electronic means.

Refer to the schedule of fees (shown below) for charges and additional fees that may apply.

ADDITIONAL DISCLOSURE INFORMATION

You will receive an imaged account statement each month.

ASSIGNMENT OF BENEFICIARIES

If you would like us to add a beneficiary to the account you are opening, please contact us after your account has been activated so that we may provide you instructions on how to add a beneficiary.

You may write an unlimited number of checks during the statement cycle.

Regulation D Classification Disclosure:
For regulatory and accounting purposes we may classify checking accounts as two sub-accounts: a checking sub-account and a savings sub-account. For interest bearing checking accounts, we calculate and pay interest at the same rate and in the same way on both sub-accounts. For non-interest bearing accounts, we do not pay interest on either sub-account. Subject to applicable law, we may transfer funds between these sub-accounts. We record the sub-accounts and any transfers transfers between them on our internal accounting records only. This process will be transparent to the customer and will not affect the interest you may earn, FDIC insurance, monthly statement or any other terms and conditions of your account.

FUNDS AVAILABILITY DISCLOSURE

Our policy is to make funds from your cash and check deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits will be available on the day we receive the deposit. Once the funds are available, you can withdraw them in cash and we will use them to pay checks that you have written.

For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and Federal holidays. If you make a deposit before 4:00 PM CST Monday through Thursday or before 6:00 PM CST Friday on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after these cut-off times or on a day we are not open, we will consider that the deposit was made on the next business day we are open.

LONGER DELAYS MAY APPLY

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Funds may not be available until the second business day after the day of your deposit. However, a minimum of the first $225.00 of your deposits may be available on the first business day.

If we are not going to make all of the funds from your deposit available on the first business day, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit.

If you will need the funds from a deposit right away, you should ask us when the funds will be available.

In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

  • We believe a check you deposit will not be paid.
  • You deposit checks totaling more than $5,525.00 on any one day.
  • You redeposit a check that has been returned unpaid.
  • You have overdrawn your account repeatedly in the last six months.
  • There is an emergency, such as failure of communications or computer equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the 7th business day after the day of your deposit.

SPECIAL RULES FOR NEW ACCOUNTS

If you are a new customer, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,525.00 of a day’s total deposits of cashier’s, certified, teller’s, traveler’s, and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you (and you may have to use a special deposit slip). The excess over $5,525.00 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a US Treasury check) is not made in person to one of our employees, the first $5,525.00 will not be available until the second business day after the day of your deposit.

Funds from all other check deposits will be available on the 11th business day after the day of your deposit.
